CONCLUSION OF THE SALES AND PURCHASE CONTRACT

After choosing the property and making the final decision on the purchase, you will have to conclude the sales and purchase contract. To start the procedure, the buyer only needs to have a passport and 1,000 euros to make an advance payment.

According to Turkish law, the sales contract is made in three identical copies in two languages. These languages are English and Turkish.

The contract has to contain such mandatory information as:

  • Official data about the seller and buyer
  • Data on the real estate subject of the contract. Namely: floor layout, construction features, date of commissioning and so on
  • Payment Terms
  • Obligations of the seller and the buyer
  • Legislative and legal procedures

Required documents:

  • Photocopy of passport or ID
  • Surnames and first names of mother and father both from the side of the buyer and from the side of the seller

To issue Title Deed (TAPU), the following procedure must be performed:

 

1. Get Turkish ITN

  • The procedure is free and takes only a few minutes. You can get an ITN at any branch of the Turkish tax office. You will need your ITN in the future to open an account with a Turkish bank, obtain a residence permit in Turkey and pay taxes.

2. The transfer of title from the seller to the buyer occurs in the Cadastral Office in the presence of the buyer, seller and sworn translator.

  • Sales tax is 3% of the estimated value of the object. It is specified in the expert report
  • Submission of all the documents and cadastral fees cost about 200-500 euros
  • Translation services cost 100 euros
 

3. For registration of TAPU, it is necessary to provide the following documents:

  • Buyer's foreign passport and its notarized translation.
  • ITN
  • 4 color photos 3x4 cm
 

4. Registration of related documents for the new owner

  • Registration of the registration certificate "Iskyan"
  • DASK Insurance
  • Registration of water and electricity meters

If you wish, you can also open a bank account in your name in any Turkish bank. This will help to further simplify the procedure for paying bills for water, electricity and telephone by instructing the bank to automatically make such payments using your bank account.

are eligible to obtain a residence permit

To visit Turkey as a tourist or with a business purpose for a period of up to 60 days, most foreigners will not need a visa. To stay for more than 3 months, you need to apply for a residence permit.

There are several ways to obtain a residence permit in Turkey (for researchers, students, foreigners, married to citizens of the Republic of Turkey, etc). However, the simplest and most reliable option is to obtain a residence permit by foreigners who confirm their ownership of real estate. The presence of TAPU makes it possible to apply for a residence permit for one to two years. After this period, the residence permit can be extended for another two years. After five years of living in Turkey with a residence permit, it becomes possible to apply for citizenship.

An apartment purchased by installments may be rented out. In this case you still do not have TAPU, but the developer gave the right to move in. In this case, a notarized lease agreement gives you the right to obtain a residence permit.

The process of obtaining a residence permit so far takes a period of 14 days to 2 months.

On the website of the General Directorate for Migration it is necessary to fill out an application and find out the date of the meeting with the specialist (time and date when it will be necessary to arrive at the office of the migration department with a package of following documents):

  • The application form for a residence permit, filled out on the website in one copy. It must be printed and signed.
  • 4 passport photos
  • The original passport and a photocopy of the passport with personal data (the page with the photo, last entry, the expiry date of the passport). Your passport should have at least six months of validity.
  • Evidence of your solvency in this case is the bank statement for the required amount for living during the year.
  • If you previously received a residence permit, you must provide its original
  • Copy of TAPU (for those who own the property)
  • Certificate from the cadastral office on certification of the indicated address for residence (in case of renting a house, the original lease agreement is provided, etc.)
  • Health insurance issued in Turkey for the entire duration of the residence permit (for citizens older than 18 and younger

If you have not provided all the necessary documents, you have the opportunity to bring the missing papers to the office of the Migration Service within 30 days. If these documents have not been submitted, the whole process is cancelled and considered invalid.

In case you have been refused a residence permit, you can stay in Turkey only until the end of the visa or previous residence permit.

A spouse, parents (pensioners) and children under the age of 18 can obtain a residence permit. All other relatives over 18 years of age, parents, brothers, sisters can obtain a residence permit only if the owner has Turkish citizenship.

Also, according to the new law, if you want to obtain a residence permit for your minor children, the apostille must be placed on the birth certificate.

Obtaining citizenship instead of a residence permit

Any foreigner can apply for Turkish citizenship. There are several options:
